Terms of Service

AVEY.IO TERMS OF SERVICE Effective Date: January 1, 2026

1. Agreement to Terms

By creating an account or using Avey.io ("Avey," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our service. These Terms constitute a binding legal agreement between you and Avey Creative LLC [or your entity name].

2. Eligibility

You must be at least 13 years old to use Avey. By using the service, you represent and warrant that you meet this requirement. If we learn that a user is under 13, we will terminate their account immediately.

3. Accounts

You are responsible for all activity under your account. You may not share, sell, or transfer your account. You must provide accurate information at signup and keep it current.

4. Acceptable Use

You agree not to use Avey to:

• Generate, store, transmit, or distribute content that is illegal under applicable law, including but not limited to content that sexually exploits or depicts minors in any way

• Harass, threaten, or harm any individual

• Violate any third-party intellectual property rights

• Attempt to reverse engineer, decompile, or tamper with our software or infrastructure

• Use the service for any purpose that violates U.S. federal or state law

Violation of this section may result in immediate account termination and, where required by law, reporting to relevant authorities.

5. AI-Generated Content

Avey uses artificial intelligence to assist in content creation. You acknowledge that:

• You are solely responsible for reviewing and approving any AI-generated content before use

• AI outputs may be inaccurate, incomplete, or unsuitable — we make no guarantees about output quality

• You retain responsibility for ensuring any content you publish or distribute complies with applicable laws and third-party rights

6. Content Ownership

You retain ownership of content you create using Avey. By using the service, you grant Avey a limited license to process and store your content solely for the purpose of providing the service. We do not claim ownership of your scripts or projects.

7. Subscriptions and Billing

Payments are processed via Stripe. Subscriptions renew automatically at the end of each billing cycle unless canceled. You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods unless required by law.

8. Termination

We reserve the right to suspend or permanently terminate accounts that violate these Terms, at our sole discretion and without prior notice. You may delete your account at any time. Upon termination, your right to access the service ends immediately.

9. Disclaimers

Avey is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Avey Creative LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State]. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property or confidentiality violations.

12. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the service after the effective date of updated Terms constitutes acceptance.
